Dismissal

Read here about your options and rights if you are unlucky as to be dismissed – e.g. the rules on notice periods and on how you can already start education and job searching during the period under notice. Or how to submit your notice of termination.
Notice periods checks, information meetings at your local branch and not least courses in CV, job search and job interviews. These are among the elements that HK offers dismissed members.

HK guarantees that you can talk to an HK adviser within 24 hours on working days. You will receive help to ensure that the rules of your dismissal have been complied with. And what to do if they are not.
You will also be offered participation in Move on – from dismissed to in great form (in Danish) which is HK’s offer for you if you have been dismissed. Here you can get help for your job search, to create a good CV and with turning your working life in a new direction if that is what you need.

CHECK YOUR POSSIBILITIES

Most of HK's collective agreements set out special rights in case of dismissal.

Typical rights are:
  • Paid time off to take advice
  • Education during the period under notice

Exactly what you are entitled to if you are dismissed depends on which area you are employed in and which collective agreement you are comprised by.
Contact your local HK branch to hear more on +45 7411 4545.

IF YOU HAND IN YOUR NOTICE OF RESIGNATION

Get good advice on how and when to hand in your notice of resignation.
There are no requirements for how your notice of resignation should look, what it should contain or when it should be handed in. But there are some rules of thumb that are worth following.

THREE PIECES OF ADVICE ON DISMISSAL

It is almost impossible to prepare for how to handle a dismissal. Because whether
your employer had given advance notice that dismissals were coming, or you have sensed that things were not too good in the enterprise, your reaction will not come until the dismissal is a reality.

Here are three pieces of advice worth remembering if you should end up in that situation.

Bring a person to the dismissal interview
A good manager will have ensured that your union representative participates in the interview. If you do not have a union representative, then ask to have a colleague that you trust participate in the interview. It is always sensible to have two persons hear what is being said.

Do not enter into agreements
If your manager wants you to sign an agreement on the terms of your dismissal, say no. You may sign for having received the notice of dismissal. Write e.g.: "I have received my notice of dismissal, but have not yet had a chance to assess the terms".

Get HK's assessment of the dismissal
As soon as you have received your notice of dismissal and the interview is over, you should contact your local HK branch. They will assess if your dismissal is with good cause and if legislation and collective agreement rules have been complied with.

IS THE DISMISSAL OKAY?

The Danish Salaried Employees Act and the collective agreements set out rules on how dismissals must be carried out. For instance, a dismissal must be based on objective criteria, such as the financial circumstances of the enterprise or because job assignments disappear. There are also rules on the length of the period of notice, which depend on your length of service in the workplace, and on how an enterprise must act in case of a large number of dismissals.

Is the dismissal with good cause?
